CMS Releases Home and Community-Based Services Compliance Toolkit
The Centers for Medicare & Medicaid Services (CMS) today issued an informational bulletin announcing the availability of a Home and Community-based (HCB) Settings Toolkit (available here under “Settings Requirements Compliance Toolkit”) intended to assist states and stakeholders in developing Home and Community-Based Services (HCBS) 1915(c) waivers and 1915(i) State Plan Amendment (SPA) or renewal applications.
The toolkit includes:
- A summary of the regulatory requirements of fully compliant HCB settings and those settings that are excluded.
- Schematic drawings of the heightened scrutiny process as a part of the regular waiver life cycle and the HCBS 1915(c) compliance flowchart.
- Additional technical guidance on regulatory language regarding settings that isolate.
- Exploratory questions that may assist states in the assessment of residential settings.
The additional guidance released by CMS today is intended to inform states of recent HCBS regulatory changes and provide technical guidance to states to assist in complying with the new requirements. CMS indicates that it aims for this process to be one of a “dialogue” with the states, noting that toward this end and with respect to still-forthcoming guidance regarding non-residential settings for HCBS participants, CMS is “providing additional flexibility in timeframes for states to address non-residential settings.”
